Is Mailchimp GDPR Compliant?

Verdict: Partially — usable but with significant limitations for European businesses

Mailchimp is technically GDPR compliant with a DPA and SCCs for EU-US transfers. However, it lacks EU data hosting, has had past GDPR enforcement actions against it in Germany, and European data protection authorities have raised concerns about its data practices. Many European businesses choose EU-based alternatives.

The Compliance Issues

German Court Ruling (2022): A German court ruled that using Mailchimp violated GDPR because it transferred European subscriber data to the US without adequate safeguards at the time. While Mailchimp subsequently updated its data transfer mechanisms, this ruling put Mailchimp under scrutiny across Europe.

No EU Data Hosting: Mailchimp processes all data in the US. Standard Contractual Clauses are in place, but data does not stay in the EU. For many European DPOs, this remains a concern.

Intuit Ownership: Mailchimp is owned by Intuit, a large US corporation. The US Cloud Act means US authorities could theoretically access data held by US companies regardless of where it is stored.

What Mailchimp Does Provide

  • Standard Contractual Clauses for EU-US transfers
  • GDPR-specific features: double opt-in, unsubscribe management, consent tracking
  • Data deletion tools for individual contacts

The Marketing Consent Issue

This is where most European businesses using Mailchimp get into trouble. GDPR requires a lawful basis for email marketing — typically explicit consent. Many businesses:

  • Import contacts who never specifically consented to marketing emails
  • Use pre-ticked boxes or bundled consent
  • Fail to record when and how consent was obtained

Mailchimp provides the tools to manage consent correctly — but it cannot fix underlying consent problems with how you collected your list.

EU-Based Alternatives

If EU data hosting is important for your organisation, consider:

  • Brevo (Sendinblue): Paris-based, EU data hosting, GDPR by design, similar pricing
  • MailerLite: Lithuanian-based, EU hosting available, strong GDPR features
  • Rapidmail: German-based, servers in Germany, built for DACH market
